The role of the estate agent in Italy
In Italy, the profession of estate agent (mediator) is regulated by law. An agent may act:
for both parties (seller and buyer), or for one party only (seller-only or buyer-only).
In all cases, the agent must be properly registered and must clearly disclose their role, setting out the rights and duties of all parties involved.
A key point: an agent is entitled to commission from the buyer only where that agent has introduced the buyer to a specific property and the purchase of that property is successfully concluded. The right to commission arises when the buyer is formally informed that the seller has signed acceptance of the buyer’s written offer.
Unless agreed otherwise in writing, the operating principle remains simple: no fees are due for activities not expressly agreed in advance, following a “no cure, no pay” approach.
